1. Acceptance of Terms
By activating a service with CoLi Link Ghana Limited (“CoLi Link”), you agree to be bound by these terms. This agreement applies to all services, including VPS/VDS hosting, domain registration, and web hosting.
2. Licensed ISP Compliance
As a licensed ISP established in 2019, CoLi Link operates under the laws of the Republic of Ghana. Users must comply with the Ghana Data Protection Act and the Cybersecurity Act. Any illegal use of our infrastructure for "Sakawa" (cyberfraud), hacking, or distribution of illicit content will result in immediate termination without refund.
3. Resource Usage (VPS vs. VDS)
  • VPS: Shared resources. Users must not exceed fair-use CPU/RAM limits that negatively impact other users on the node.
  • VDS: Dedicated resources. Users have exclusive access to assigned resources, but must still comply with network security protocols.
4. Prohibited Content & Activities
Clients are strictly prohibited from using CoLi Link servers for:
  • Unsolicited bulk email (Spamming).
  • Hosting or distributing copyrighted material without authorization.
  • DDoS attacks or network scanning.
  • Cryptocurrency mining on shared VPS nodes.
5. Billing & Payments
Services are prepaid. CoLi Link supports payments via Mobile Money (MoMo), local bank cards, and transfers. Subscriptions not renewed within 3 days of the due date will be suspended. After 7 days, data may be permanently deleted for security and resource management.
6. Data Sovereignty & Backups
All primary data is stored at our flagship hub in Accra, Ghana. While we maintain 99.9% network uptime, clients are responsible for maintaining their own off-site backups. CoLi Link is not liable for data loss resulting from hardware failure or user error.
7. Direct Peering & Latency
Our direct peering to Nigeria and South Africa is provided as-is. While we optimize for ultra-low latency, CoLi Link is not responsible for lag caused by third-party upstream providers or international subsea cable maintenance.
8. Limitation of Liability
CoLi Link’s liability for any claim shall not exceed the amount paid for the service during the preceding one-month period.
 

Domain Registration Agreement

  1. Registration & Ownership
    CoLi Link acts as a facilitator between the client and the relevant Domain Registry (e.g., .gh, .ng, .za, or ICANN for .com). The client is the legal owner of the domain and is responsible for providing accurate "WHOIS" contact information.
  2. Domain Expiration & Recovery
    It is the client's sole responsibility to renew domains before the expiry date.
  • Grace Period: Some domains may have a short grace period for renewal.
  • Redemption Phase: Once a domain enters the "Redemption" phase, the Registry may charge a significantly higher fee (often GHS1000+) to recover the domain. CoLi Link is not liable for domains lost due to non-payment.
  1. .gh (Ghana) Domain Specifics
    As a local provider, we facilitate .gh registration. Clients must comply with the policies of the Ghana Domain Name Registry (GDNR). Certain premium or restricted names may require additional verification or documentation.
  2. Transfer Policy
    Clients may transfer their domains away from CoLi Link at any time, provided all outstanding invoices are cleared. Domain transfer codes (EPP codes) are available via the client area.

General Liability (All Services)

  1. Service Disruptions
    While our network is directly peered to Nigeria and South Africa, CoLi Link is not liable for downtime caused by international subsea cable cuts (e.g., WACS, MainOne) or force majeure events within the Accra power grid.
  2. Local Law Enforcement
    CoLi Link will cooperate with the Ghana Police Service or authorized cybersecurity agencies if a warrant is presented regarding illegal activities hosted on our infrastructure.
Regional Law Enforcement Cooperation
 
1. General Cooperation Principle
CoLi Link is committed to maintaining a safe digital environment across Africa. We will cooperate with authorized law enforcement and regulatory agencies in all jurisdictions where we provide direct peering and connectivity services, specifically Ghana, Nigeria, and South Africa.
2. Compliance with Nigerian Law
In accordance with the Nigerian Cybercrime (Prevention, Prohibition, etc.) Act and the Guidelines for the Provision of Internet Service issued by the NCC, CoLi Link will:
  • Mandatory Reporting: Report any suspected cybercrime activity occurring on our Nigerian-peered routes to the relevant authorities as required by law.
  • Information Disclosure: Comply with lawful requests from the Nigeria Police Force (NPF) or the Economic and Financial Crimes Commission (EFCC) when supported by a valid warrant or production order.
  • Takedown Procedures: Promptly respond to official notices to remove or disable access to content deemed illegal under Nigerian law, including financial fraud and identity theft.
3. Compliance with South African Law
Under the South African Cybercrimes Act 19 of 2020 and the POPI Act, CoLi Link adheres to the following:
  • 72-Hour Reporting Obligation: As an Electronic Communications Service Provider (ECSP), we are legally mandated to report any cybercrime (such as unauthorized data access or cyber extortion) to the South African Police Service (SAPS) within 72 hours of discovery.
  • Mutual Legal Assistance: We will facilitate cross-border investigations in accordance with the SADC Protocol on Mutual Legal Assistance and bilateral treaties between South Africa and Ghana.
  • Data Breach Notification: In the event of a security compromise affecting South African data subjects, we will notify the Information Regulator as required by Section 22 of the POPI Act.

4. International Coordination
Clients acknowledge that Ghana and Nigeria have formal bilateral agreements for joint cybercrime policing. CoLi Link reserves the right to share intelligence with the Ghana Police Service and its international counterparts to dismantle transnational criminal networks.

Global Legal Compliance & Law Enforcement
1. International Data Privacy Standards (GDPR & Beyond)
While headquartered in Ghana, CoLi Link acknowledges the global nature of data. For clients handling data from the European Union (EU) or other strictly regulated regions:
  • GDPR Alignment: We apply core principles of the General Data Protection Regulation (GDPR), including data minimization, purpose limitation, and the right to be forgotten.
  • International Data Transfers: Any transfer of personal data outside its originating jurisdiction is conducted with appropriate safeguards and, where required, the explicit consent of the data subject.
Cooperation with Global Law Enforcement
CoLi Link will cooperate with recognized international law enforcement agencies (such as Interpol or the United Nations Office on Drugs and Crime) to combat serious transnational crimes. [1, 2]
  • Mutual Legal Assistance Treaties (MLATs): We respond to requests from foreign governments through established MLAT channels or the Ghana Ministry of Justice, ensuring all requests follow due process.
  • Serious Crimes: Cooperation is prioritized for cases involving terrorism, organized crime, money laundering, child exploitation, and large-scale cyberattacks.
  • US CLOUD Act Compliance: We recognize international frameworks that facilitate lawful access to electronic evidence for serious crime investigations while protecting user privacy.
Global "Rest of World" Jurisdiction
For users outside of Africa, this agreement is governed by the laws of the Republic of Ghana.
  • Dispute Resolution: Any global legal disputes shall first be attempted through mediation. If unresolved, they will be settled in the courts of Accra, Ghana, unless otherwise specified in a custom Enterprise Agreement.
  • Sanctions & Export Controls: Users must comply with international sanctions. CoLi Link services may not be used in any country or by any individual subject to global trade restrictions.
International "Fair Use" & Anti-Abuse
To protect our reputation across global networks:
  • Global IP Health: We strictly monitor for activities that could cause our IP ranges to be blacklisted globally (e.g., massive email spam or hosting malware).
  • Copyright (DMCA): We respect international intellectual property rights. If we receive a valid international "takedown notice," we will notify the client and may suspend content in compliance with international norms.
